Terms of Service
These are interim terms. They set out, in plain terms, the rules for using PickTonight today. Full terms are being prepared with legal advice and will replace this page. When they do, the app will ask you to agree to them.
1. Who we are, and this agreement
PickTonight is run by Forcevolve Ltd., a company registered in Bulgaria (UIC / ЕИК 207839697), registered address: 42 Velizar Velkov St., floor 3, flat 14, Manastirski livadi district, 1618 Sofia, Bulgaria ("we", "us"). Contact: support@forcevolve.com.
These terms, including the Community Guidelines in section 5, are the agreement between you and us when you create a PickTonight account or use PickTonight. Our Privacy notice explains what we do with your personal data.
2. Who can use PickTonight
- You must be at least 13 years old. Sign-up asks for your birth date and refuses anyone younger. If the law where you live needs a parent's or guardian's consent for someone your age to use a service like PickTonight, you need that consent.
- If you are under 18, your profile stays private and you can't make it public. People you aren't friends with or in a group with can't find you in search, and you aren't suggested to anyone.
- Every new account starts with a profile that is not public (someone you are not connected with cannot open it) and off the challenge leaderboard. You choose whether to make your profile public or to join the leaderboard, in Settings → Privacy.
- You may not use PickTonight if we have closed your account for breaking these terms.
3. Your account
- One account per email address. You sign in with your username or email address and your password.
- Your username is public: it is how other people find you, and it appears next to what you post. Your email address is never shown to anyone.
- Give true details when you sign up, including your birth date.
- Keep your password to yourself. You are responsible for what is done with your account. If you think someone else has used it, change your password in Settings and tell us.
- Do not sell, lend or hand over your account to anyone else.
4. Using PickTonight
PickTonight is free. It suggests films and series from your tastes, and helps you choose what to watch with friends, partners and groups. Nothing in PickTonight can be bought today.
When you use PickTonight, do not:
- break the law, or help anyone else break it;
- use someone else's account, or try to get into accounts, data or systems that are not yours;
- copy the catalogue or other people's content out of PickTonight in bulk, or use bots, scrapers or other automated means to use it;
- interfere with how PickTonight works, get around its limits (for example the fair-use limits on catalogue lookups, posts, reports and friend requests), or get around a block, a mute or a restriction we have placed on you, for example with another account;
- import a watch-history file that is not an export from your own account (the importer takes TV Time and Letterboxd exports, and reads them on your device);
- post anything the Community Guidelines below do not allow.
5. Community Guidelines
PickTonight is for talking about films and series with people you choose. These rules apply to everything you post or share: comments on titles and episodes, club topics and posts, watch-party comments, lists and their names and descriptions, group, club and poll names, and your profile. Do not post or share:
- Illegal content: anything that is against the law, including content that infringes someone else's copyright or other rights.
- Anything that endangers children: any content that sexualises, exploits or endangers a child. We remove it, close the accounts behind it, and pass it to the authorities where the law requires.
- Harassment or bullying: targeting, threatening, intimidating or humiliating another person.
- Hate or discrimination: attacking people for who they are, such as their race, ethnicity, nationality, religion, sex, gender, sexual orientation, disability or age.
- Violence or threats: threatening or encouraging violence against anyone.
- Self-harm: promoting or encouraging suicide, self-harm or eating disorders. If you are worried about someone, report it. If anyone is in immediate danger, contact your local emergency services: PickTonight cannot provide emergency help.
- Sexual or explicit content.
- Impersonation: pretending to be another person or organisation, or misleading people about who you are.
- Spam or advertising: unwanted promotion, repeated posts, scams or misleading links.
- Spoilers without the spoiler flag, where the app offers one.
6. What you post
What you post stays yours. So that PickTonight can work, you give Forcevolve Ltd. a non-exclusive, royalty-free, worldwide permission to store, copy, adapt for display, and show what you post, only to run PickTonight and only to the people the feature and your settings show it to. You confirm that you have the right to post it.
The permission ends when you delete the content or your account, except where the Privacy notice says something stays: the text of your comments stays in its thread with the author shown as "[deleted]"; what you added to shared spaces (such as titles in other people's lists, or topics and polls you started) stays without your name; groups, clubs and lists that have other members pass to their longest-standing member; and copies we keep for moderation or because the law requires it stay for as long as we need them for that.
You are responsible for what you post. We do not check posts before they appear.
7. Reporting, and what we do
- Report a profile, a comment, a club, a club topic or member, a watch-party comment or a public list in the app, and pick the reason. Block someone to keep the two of you apart, or mute them to stop seeing what they post.
- Illegal content (EU Digital Services Act, Article 16): report it with the reason "Illegal content". The app then asks you to explain why you believe it is illegal and to confirm that you are reporting in good faith. You can also send a notice, or contact us as an authority, at support@forcevolve.com.
- People, not automated filters, review reports. Reports about children's safety, illegal content, violence and self-harm are reviewed first. We may remove or change the content, make a list private, or suspend or close an account. Where the law requires it, we pass information to the police or judicial authorities (see section 4 of the Privacy notice).
- How we tell you. When we decide on a report, we send a "Moderation notice" in the app: to the person who reported, whether we took action; and, when we removed or changed someone's content, to its author, saying what we did, which rule or law it broke, and that a person decided. We never tell the author who reported them.
- If you disagree with a decision, email support@forcevolve.com with your username and a person will look at it again. You may also have other options under the law where you live, such as going to court.
8. Third-party content and YouTube
Trailers and extras (YouTube)
Trailers and extras on title pages play in YouTube's embedded player, and their thumbnails come from YouTube: PickTonight uses YouTube API Services to show them. By playing a video in PickTonight you agree to be bound by the YouTube Terms of Service, and Google handles that viewing under the Google Privacy Policy. What YouTube receives is described in our Privacy notice.
Film and series information
Film and series details, posters, photos and streaming availability come from TMDB (The Movie Database), and IMDb ratings from the OMDb API. That content belongs to them or to the people who licensed it to them, and it may be incomplete, out of date or wrong, including which services carry a title where you live. The full credits are in the app under Settings → About the app → Licenses & data sources. When you leave PickTonight for a streaming service or another site, that site's own terms apply.
9. No guarantee, and our liability
We provide PickTonight free of charge, as it is and as available. We do our best to keep it running and accurate, but we do not promise that it will always be available or free of errors, or that its recommendations, match percentages, ratings or availability information are right for you.
As far as the law allows, we are not liable for loss that was not foreseeable, for what other users post or do, or for services run by others (such as YouTube, TMDB or a streaming service). Nothing in these terms excludes or limits our liability where the law does not allow it, for example for harm we cause intentionally or through gross negligence, and nothing takes away rights you have as a consumer that cannot be waived.
10. Ending your account
- You can delete your account at any time in Settings → Delete account, or on the web at /delete-account. Deletion is immediate. The Privacy notice explains what stays and for how long.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires us to, or to protect other people. We may also change PickTonight, or stop offering it; if we stop, we will tell you in the app beforehand where we can.
11. Changes to these terms
When we change these terms we update the date and the version at the top of this page, and the app asks you to agree to the new version before you continue. If you do not agree, you can sign out, or delete your account from the same screen.
12. Governing law
Interim, until the full terms: these terms are governed by the law of Bulgaria. If you use PickTonight as a consumer, this does not take away the protection given to you by the mandatory laws of the country where you live, and where those laws give you the right, you can bring a claim in the courts there.
